A young man – a Baptist preacher – stopped by Border Patrol. Cops demand to search his car. Preacher invokes 4th amendment rights. Cops allege the K-9 unit alerted on drugs or humans secreted in the preacher’s car, though preacher doesn’t see dog react at all. Cops claim dog equals probable cause and invoke hammers to smash preacher’s windows out, tasers used repeatedly on preacher, preacher’s face torn up into bloody mess as cops smash his face into broken glass.
Don’t forget these Border Patrol thugs are now conducting operations within 100 miles of the border. This is how our government is going to protect us from the scourge of Mexican trafficking of marijuana that Americans want to smoke and cheap labor that Americans want to hire. Is this how President Obama plans to “crack down” on drug use in America?

the only person doing anything illegal there was the alleged preacher a k9 hitting by all local, state and federal law is enough probable cause to search. california might legalize marijuana but it’s still a federal violation, and trafficking marijuana is even worse. so yea i respect the bp and what they do legal marijuana is one thing once taxed and governed, but the illegal trafficking transporting distribution and usage of marijuana is not acceptable so to you pos pot smokers get a life!

This man was detained and abused for not submitting like a punk to the bozos who abused him. Are you really going to sit there and swear that you are even more of a bozo yourself? Would you suggest that Patrick Henry was an ass when he said, “Give me liberty or give me death?”

Ok how can I put this nicely…you’re a dumb ass! If you’re going to preach about human rights and probable cause, 4th ammendment and all that perhaps you should do some research first and understand the authorities and laws that actually pertain to those topics. Its clear to me that you have no idea what went on there. Firstly k-9′s are trained that when a “sniff” is conducted and if they hit on something (aka drugs or human contraband), they sit calmly in front of the area where they hit. Thats how the handler knows if they hit. Thats also why this paster would have seen no reaction from the k-9. Two INA 287 and Martinez-Fuente vs. the United States (supreme court ruling) are the two statutes by which border patrol derive there authority to establish checkpoints and conduct stops at those checkpoints. There is no 4th ammendment violation because they are not being seized. They are being legally detained. A K-9 alert automatically gives the agent or officer probable cause which is how they are then legally able to search the vehicle under the readily mobile conveyance warrant exception(corroll doctrine). This pastors non compliant and resistant behavior made him a safety issue to everyone around him. The State Troopers who responded at the checkpoint were called because this pastor was also impeding the normal flow of traffic (also a safety issue). The Pastor refused to comply with the Troopers orders which put him in violation of state law. His continuing resistance again was an officer safety issue. By refusing to comply the Troopers had legal authority to remove him from the vehicle. He was tased because of his resistance and because if they attempted to remove him without incompacitating him he might have caused harm to one of the agents or troopers. As a side not it was a trooper who tased him, not a BP agent. Also if you listen closely in the video, they did warn him to cover his face when they broke the glass to the car. GET YOUR FACTS STRAIGHT DUMB ASS!
I very much appreciate that he takes a stand for constitutionally guaranteed and allegedly protected rights, But if you look at him closely enough you will notice that he is the only member of the cult of himself. One of the truly insane, hate filled demagogues that are becoming a hallmark of our culture.Yuo know, like Pat Robertson.

Have to chime in here, after doing some more research on this Baptist teacher.
There are several videos of him on YouTube being very, very confrontational in multiple situations like this. At another border patrol, he stopped, but refused to roll down his window to talk to the agent at the stop. He just kept yelling to tell him when he was free to go.
I don’t necessarily support the border patrol stops, but that’s irrelevant. What is relevant is that this Pastor Anderson is a highly confrontational individual, who put himself into situations where agents, who are just doing their jobs, have to respond. If you act suspicious, you will be treated as a person of suspicion.
This is so messed up. That Baptist minister is a true American who is standing up as a human to the inhuman Border Patrol Fascists. I hope more of the straight community begins to wake up and realize its not just us “potheads” who are going to have their heads shoved into glass, they are next. It’s overdue time for all of us cannabis users and friends to get together and fight these fascist scum laws. Remember Stonewall! I wear my MPP “I am not a criminal! Right, but sometimes you’re damned if you do, damned if you don’t. You gotta give it to this dude, he never cracked, I know I would have, especially if I didn’t have anything, but like I said, I am a little jaded after a couple of these same experiences.
Ironically when I have been busted with stuff, I was either let go, or cut a ticket. The times I got beat up, I really had nothing and had done nothing. Oh wait there is one thing I did, I was drunk both times (but not driving). Another reason to smoke instead of drink.
So, what, you give up all your rights to the bad cops and just hand them a slam-dunk case? The system rewards cops for this illegal behavior because citizens give prosecutors easy cases by not knowing and asserting their rights.
The preacher did make the mistake of not exiting the car when told to do so. When you exit, you roll up the windows and lock the doors.
Will this stop cops from fake-alerting dogs or beating you up? No, bad cops are going to break the law no matter what you do. However, assert your rights properly and obey the officer politely and your NORML Legal Committee attorney whups ass on that whole police department in a court of law.
@ itistime, I don’t think it’s so much that the site is saying “Don’t talk to cops” or “Don’t authorize a search” but it’s really saying that, by being citizens of this nation, we are given certain rights to protect our Life, Liberty and Pursuit of Happiness and no police officer can tell me that I don’t have those rights. I will protect myself from assault by a police officer and I will not give up my protection from an illegal search and seizure because some corrupt believes he’s above the law. Laws were made to protect the people, not to attack them.

Its horrible to think how a govt. can prosecute its own people for doing something that hurts nobody including themselves anyway keep in high spirits and keep up the good fight and spreading the word of God your virtue will come!
On all these activism sites they always say the same thing:
“Don’t authorize a search”
“Don’t talk to the cops”
But when you do that, this is what happens. They bring out a dog, run him around the car and claim that he signaled them to something. They claim they have probable cause and proceed to abuse you for “resisting” while they tear your car to shreds. All because of “a dog’s signal”. But there never is a signal. And does that matter in court, when it’s your word against theirs?
I have been beaten up by the police for doing absolutely nothing, twice! It matters to them NOT AT ALL that you have done nothing! The more you beg for mercy and ask them to stop, the harder they beat you. It obviously gets their dicks hard. You know C Diaz probably went home and jerked off to what he had done. Some cops are monsters, some are wannabe monsters, and the rest think they’re SUPPOSED to be monsters! That is why they become cops, and our fucked up system rewards them for it! And never holds them accountable! Most Americans seem to think this is the way cops are supposed to be!!!
