Madison Heights police seized 21 marijuana plants Monday night that the homeowner said he believed were legal under the state’s medical marijuana law.
But at this point, police can’t say whether the plants were legal or if the man was over the limit.
“We don’t know what the rules are,” Madison Heights Police Chief Kevin Sagan said. “This is a new situation for all of us.”
Answers could come by the end of this week from the Michigan Department of Community Health, which has been hammering out rules for the medical marijuana law since it went into effect Dec. 4. The department is required by the state to launch a medical marijuana program by Saturday.
Michigan patient advocates said they believe this seizure is the first significant event to test the law’s limits. Robert Redden, the 59-year-old whose home was raided, said police took 21 marijuana plants, money and a notebook of contacts. Police confirmed the raid Tuesday but provided no details.
It is possible that no charges will be filed against Redden, who said he has the requisite doctor’s recommendation to use marijuana to ease the pain of hip arthritis.

Whenever I read these reports, I always wonder, “How many budding plants did they recover?” Merely stating that the patient had “21 plants” is as meaningful as asking what ten dogs weigh… it really depends on whether they are chihuahuas or Saint Bernards, doesn’t it? How many of these “21 plants” were little clones or seedlings or just in vegetative stage, where they are worthless as medicine and weeks away from any black market value?
According to the Michigan law, “12 marihuana plants kept in an enclosed, locked facility. Any incidental amount of seeds, stalks, and unusable roots shall also be allowed under state law and shall not be included in this amount.” (Lovin’ the old-school “marihuana” with an ‘h’) It doesn’t appear that Michigan law has a clause like Oregon’s law, where police may only seize the number of plants that is over the limit (i.e., they’d take 9 and leave 12). I’d check the Michigan Rules that go into effect tomorrow, but their website won’t let me.

Actually, not to double post but. I think what happened is that they didn’t investigate enough to know that the guy was using it for medical marijuana. All they knew was he was growing plants in his house. And said lets raid him! That’s all they knew. Because now it’s after they arrest him they are like OK, crap..
What are the medical marijuana laws? And that is the point they are at right now. Not knowing the laws because they didn’t know he grew medical marijuana. They just knew he was growing plants inside. Kinda reminds me of that fake Barry Cooper bust. Catching corrupt “kops”
This is very true. How can they even say they don’t know the law yet take him in for breaking the law? That makes no sense at all. These cops and the DEA must be stopped before they get out of hand! They are sending a message to our citizens and judges and whoever else, that medical marijuana facilities are no good for the public and they just break the law. This is the message they are putting across to everyone to stop medical marijuana from being legalized. They know this is the first step to legalizing marijuana for recreational use and they are trying to stop us in this first step. THEY MUST BE STOPPED!

I was about to say the same thing, if they were unsure of the law they had no reason to believe the law was being broken,plain and simple.
What a shame. It’s sad to me that police will enforce laws they admittedly have not read/took the time to understood.
Is it legal these days to harass citizens with law enforcement and figure out if there was just-case after the fact?
