Thank you for contacting me in regard to H.R. 3939, the Truth in Trials Act of 2009. I appreciate you taking the time to share your thoughts with me on this issue.
As you may know, H.R. 3939 was introduced by Congressman Sam Farr on October 27, 2009. This legislation would allow any person on trial for a federal marijuana-related offense to introduce evidence that the alleged marijuana-related activities were performed in compliance with state law regarding the medical use of marijuana, allow an affirmative defense to a marijuana prosecution that the alleged marijuana-related activities complied with state law regarding the medical use of marijuana, and prohibit the seizure of plants grown or stored under a physician’s recommendation or by order of a state or municipal agency in accordance with state law regarding the medical use of marijuana.
While I personally oppose legalizing marijuana, I have been supportive in the past of the rights of states, like Washington, to determine what course of action they choose on this difficult issue.
Currently, H.R. 3939 is under review in the House Judiciary Committee. Please know that I will keep your thoughts in mind should this legislation reach the House floor for a vote.
