Legislative Update with NORML Deputy Director Paul Armentano

• ALABAMA: The Michael Phillips Compassionate Care Act (HB 25) which seeks to enact legal protections for authorized medical marijuana patients, has been marked for reintroduction in the Alabama Legislature for the session starting on February 7th. It is currently assigned to the House Committee on Health. A separate medical cannabis bill, House Bill 66, has also been prefiled in the House and is also before to the House Committee on Health, while a third measure that seeks to reduce penalties on adult cannabis possession is anticipated to be introduced shortly. • INDIANA: Senate lawmakers heard testimony on Tuesday, January 24, in favor of legislation, SB 347, to decriminalize marijuana possession penalties in Indiana. Lawmakers on Senate Committee on Corrections, Criminal, and Civil Matters did not vote on the measure. Therefore, there is still time for constituents to contact their Senate members and encourage them to support marijuana law reform. You can do so via NORML’s ‘Take Action Center’ here. A separate House measure, HB 1370, that seeks to legalize the use of cannabis for medicinal purposes, is pending before the House Committee on Public Policy.
• KANSAS: House Bill 2330, which seeks to enact legal protections for authorized medical marijuana patients, was heard by the House Committee on Health and Human Services on Tuesday, January 24th. • NEW HAMPSHIRE: Members of the House Criminal Justice Committee heard testimony on Thursday, January 25, in favor of House Bill 1705, which seeks to allow adults age 21 or over to use marijuana legally in their home. The measure also seeks to establish a regulated cannabis market governing the wholesale production and sale of marijuana. Non-commercial transactions involving less than one ounce of cannabis would not be subject to state taxation or regulation under the measure. • The House Criminal Justice Committee is also scheduled to hear testimony this Thursday in favor of separate legislation, HB 1526, which seeks reduce the penalties on minor marijuana possession offenses (up to one ounce) from a criminal misdemeanor punishable by up to one year in jail and a $2,000 fine to a nominal monetary penalty of no more than $100.00. • VIRGINIA: Legislation seeking to establish a joint study committee to investigate the fiscal impact of regulating the production and sale of marijuana to adults 21 and over is anticipated to be heard by the Virginia House Committee on Rules as soon as this Thursday. • Mark Pedersen from Sensible Missouri and Show-Me Cannabis Regulation

A young man in Riverdale, Missouri, was charged with possessing 50 grams of marijuana or less, after police say they collected loose marijuana that was scattered on the front seat of his vehicle, along with several partially-smoked joints littered on the floorboards of his car. The 18-year-old was stopped for having faulty brake lights.

During the stop, the officer said he could smell marijuana coming from his car. A drug dog was called to the scene, and they were able to locate additional marijuana located in a safe in the trunk. In addition to controlled substance charges, he was charged with drug paraphernalia, operating a motor vehicle with a dangerous substance abroad along with failure to maintaining working lamps on his car and failure to exhibit his valid drivers license.

Last night on Toker Talk Radio (5pm Pacific http://live.norml.org), John Payne from Show Me Cannabis Regulation, a group fighting to legalize marijuana in Missouri, called in to inform us of breaking news. It seems two petition gatherers were arrested in St. Charles, Missouri on Jan. 15, by police who claimed they we “soliciting without a permit”.  John was calling us to announce a protest at City Hall last night

It appears now the City of St. Charles managed to remember about this little thing called the First Amendment…

(Freedom Center of Missouri*) St. Louis, Missouri—In response to pressure from the Freedom Center of Missouri, St. Charles City Attorney Mike Valenti announced this morning that the City will drop charges against two petition circulators who were cited last weekend for gathering signatures on the city’s public sidewalks.

This controversy was sparked in the early hours of January 15, when two volunteers with the Show-Me Cannabis Regulation campaign were gathering signatures on North Main Street in St. Charles. The ballot initiative seeks to legalize the production, sale, and use of marijuana under Missouri law and to regulate it in a manner similar to tobacco or alcohol. Two police officers approached the petition circulators, issued them citations for “soliciting without a permit,” and confiscated some of the petitions, which included approximately fifty signatures. Acting on behalf of the volunteers, the Freedom Center of Missouri insisted that the First Amendment required the City to drop the charges, return the seized petitions, and to destroy any copies the police had made of those petitions. The City has agreed to comply.

A St. Louis Metropolitan Police Sargent is being accused of stealing seized marijuana and re-selling it with the help of his brother. Sgt. Larry J. Davis, a 46 year-old supervisory sergeant to the Central Patrol Division Special Operations Group, was responsible for investigating gang drug activities. Sgt. Davis would visit the company branch facilities in uniform to seize packages believed to contain marijuana, on the guise he was taking it to the lab to be tested. But instead, Sgt. Davis was taking them to his house, weighing it out with his brother, 42 year old Linus Davis, then selling it.

Federal authorities now suspect that the selling operation went on from October of 2010 until January 10th 2012. He was suspended on the 11th, and now Sgt. Davis and his brother are facing a felony count each on conspiring to possess with the intent to distribute marijuana, and also a charge of distributing marijuana. Both men made their first appearance in court this afternoon. Larry Davis was arrested in his home early this morning, his brother Linus had been taken into custody and arrested this afternoon. The indictment today is also is seeking the forfeiture of two vehicles authorities say they used in their conspiracy.

The St. Louis Metropolitan Police Department released a statement today on the matter saying in part, that upon being notified by the FBI of allegations against Larry Davis, they suspended him immediately and they were fully cooperating with the FBI on the matter.
