Lawmakers have ‘indefinitely postponed’ taking any action regarding Legislative Bill 659.

Legislative Bill 659 sought to make it a criminal offense for any person to operate a motor vehicle if any level of marijuana or non-psychoactive marijuana metabolites (byproducts) are present in their blood, saliva, urine, or any other bodily fluid.
NORML opposed this draconian legislation and thanks in large part to the many e-mails sent by NORML constituents, lawmakers have made it clear that they will take no further action on the measure this session.

Thank you again for helping NORML successfully halt this legislative threat to the cannabis community.

LB 659 makes it a criminal offense for any person to operate a motor vehicle if any level of marijuana or non-psychoactive marijuana metabolites (byproducts) are present in their blood, saliva, urine, or any other bodily fluid. Because marijuana’s main metabolite, carboxy THC, remains detectable in certain bodily fluids, particularly urine, for weeks or even months after past use, this legislation punishes drivers for simply having consumed marijuana at some previous, unspecified point in time.

This proposal is neither a safe nor sensible way to identify impaired drivers; it is an attempt to misuse the traffic safety laws in order to identify and prosecute marijuana consumers, including medical patients.

LB 659 awaits action from the Transportation and Telecommunications Committee.

I did this because I felt that new visitors randomly surfing to the show should get the show without being distracted by some folks in the webcam chats sparking up a bowl or a joint during the show.

Which leads me to this…

(Omaha World-Herald) You never know who’s watching online.

Just ask 44-year-old David K. Johnson. The former Gretna resident was arrested earlier this month after Sarpy County Sheriff’s investigators connected him to about 90 “how-to-smoke-marijuana” videos on YouTube that also feature Johnson’s sons.

Lt. Steve Grabowski said the videos — filmed over a 16-month period that ended about two months ago — show Johnson rolling joints and smoking marijuana from pipes and bongs with his two sons, ages 20 and 17.

Grabowski said an anonymous tip started the investigation, and a search warrant was issued Jan. 12 on Johnson’s then-home at 21406 Buffalo Road in Gretna. He since has moved out.

Johnson was charged with misdemeanor child abuse as well as possession of less than an ounce of marijuana and possession of drug paraphernalia

Johnson’s eldest son, Tavis Johnson, was charged with possession of less than one ounce of marijuana and drug paraphernalia and was released.

The youngest son was placed in foster care.

The father, who is out on bail, is expected back in court next month.

Now I’m not going to tell adults what to do when they are watching our show. I find nothing shameful about adults wishing to show the world they are harmless marijuana smokers. But do realize that what you’re doing and writing can be used as evidence against you in a court proceding – it is a PUBLIC forum and you have no reasonable expectation of privacy.

I won’t smoke on cam. I have no kids to worry about, no job I would lose, and I don’t worry about officers of the state bursting into my home because there may be some cannabis here. However, I am a caregiver in the Oregon Medical Marijuana Program and smoking in public would mean the end of my card and open me up to prosecution. I’m also representing NORML and the millions of us who can’t or won’t speak up to end adult marijuana prohibition. I’d prefer that folks didn’t smoke on cam and made the chat room an inviting place for people new to the community, but that’s a personal decision you have to make as a guest – how do you want us to look to the mainstream?

(Lincoln Journal-Star) A short pursuit following a traffic stop near Bridgeport, has led to two arrests and the seizure of a gift-wrapped package containing seven pounds of marijuana, the Nebraska State Patrol says.

Patrol Spokeswoman Deb Collins said at about 7:40 p.m. Tuesday, a State Patrol trooper attempted a traffic stop on a 2002 Chevy Tahoe for failing to signal on U.S. 385 near Angora, Neb.

The trooper briefly contacted the driver, who said he had no registration or insurance and had a suspended license.

No insurance, no registration, no license, seven pounds of weed… what could possibly go wrong?

Collins said when the trooper asked the driver, Miguel Velasquez, to get out of the vehicle, he sped away.

The pursuit lasted three miles and reached speeds of 60 mph. It ended when Velasquez’s Tahoe left U.S. 385 and drove into a cornfield.

The SUV ended up on its side in heavy snow, and Velasquez fled on foot, Collins said. He was found about 40 minutes later and taken into custody without incident.

Never run from police. You and your rig are not faster than radio waves, helicopters, police cruisers, and bullets. You could have gotten yourself, the pregnant girl your were driving, the police officers, and innocent motorists killed or injured. While seven pounds of weed in Nebraska is a five-year felony, it’s much tougher on your lawyer to get you out of those charges when you’ve run from the police. And of course, if you have no license, insurance, and registration, don’t drive, especially with weed! For a cool cannabis consumer with those items, this would have been a ticket for failure to signal for a driver carrying an unremarkable Christmas present.

(Lexington Clipper-Herald) Authorities plan to seize a dozen vehicles, several properties and more than $500,000 in cash as they unravel a marijuana-dealing ring they say was being run out of the Douglas County Correctional Center.

Federal prosecutors accuse 11 defendants of running a “major” marijuana trafficking organization that distributed more than 2,200 pounds of the drug.

On Monday, 10 of those people visited a federal courtroom. Among them was Shannon E. Williams, the man authorities accuse of orchestrating the drug ring from 2006 to last week.

Williams pleaded not guilty to charges of conspiracy, money laundering and criminal forfeiture. Williams has been at the county jail in downtown Omaha since shortly after his January arrest in Arizona on suspicion of indecent exposure, an arrest officials say also exposed his possession of 10 bricks of marijuana.

Since his return to face federal parole violations, it appears Williams has dealt no marijuana from the jail but instead orchestrated trafficking on the outside.

Williams has previously faced charges in crimes ranging from the murder of a rival gang member to dealing crack cocaine.

If we can’t stop people from dealing drugs from within prison, why does anyone think we can stop people from dealing drugs on the outside?

This Williams is no saint, which is even more reason I want cannabis relegalized. Why should a perfectly decent plant like cannabis be unregulated so that violent criminals can control its marketing and reap great untaxed profits? With a legal retail marijuana market, nobody who wants marijuana has to get it from the lackeys of some imprisoned murderous crack-dealing gangster.

(WOWT) The Nebraska Supreme Court upheld the finding of a lower court, ruling Thursday that a secretary who worked for a warden in the Nebraska Department of Correctional Services should not have been fired for smoking marijuana.

John Ahmann by all accounts was a good worker, but when he was randomly selected for a drug test, he tested positive for having used marijuana and was fired by the state.

Ahmann and his union went to court noting that the drug use had been during off-hours, that it had not impacted Ahmann’s “spotless” work performance and that Ahmann had expressed a willingness to stop using marijuana.

The lower court agreed that while the state might discipline Ahmann in some fashion, firing was too severe and Nebraska’s high court agreed.
