A hearing officer on Wednesday will take up the case of a 70-year-old cancer patient who is appealing San Miguel County’s decision to revoke his federal housing subsidy because he uses medical marijuana.

No reasonable person wants to see Roger Christie being held in jail without bond pending trial on these non-violent marijuana charges. None of us want to see him imprisoned for his religious use of marijuana. This debate is about the current state of the law regarding the religious use of marijuana in this country and the best strategy to legalize the religious use of marijuana. It is not a debate about the legitimacy of anyone’s religious beliefs and to make it so misses the opportunity to discuss how we all best spend our time and money bringing an end to marijuana prohibition so we may all enjoy our human rights to cannabis.

Ryan Grim at Huffington Post reports on the notion going round political circles that California’s Prop 19 (and, to a lesser extent, medical marijuana initiatives in Arizona and South Dakota, and dispensaries for medical marijuana in Oregon) will be for the Democrats what anti-Gay Marriage Equality amendments were for Republicans – the turn-out-the-base social wedge issue that helps their candidates on the ballot.

If one of the West Coast states doesn’t pull off legalization soon, the pendulum is going to swing back the other way on marijuana. The economic incentives may fade if the economy recovers and then the tax & regulate argument fizzles. And if we are going to continue working on medical marijuana, the bills and initiatives need to get better, not worse. The way it’s looking now is that the Northeast and upper Midwest are going to institute chronic conditions-only, 2 oz limit, strict registry, only personal doctor, no home grow, state-run dispensary medical marijuana for $15/gram in the next six years.
