It is with disappointment that we report on the latest tax prosecution of an activist and cannabis businessman, Paul Stanford of The Hemp & Cannabis Foundation, the broadest nationwide network of clinics specializing in medical marijuana recommendations, based here in Portland, Oregon and operating clinics in California, Colorado, District of Columbia, Hawaii, Michigan, Montana, Nevada, New Mexico, Rhode Island, and Washington.

In a case involving the Berkeley Patients Group, Inc., a medical marijuana dispensary in Berkeley, California, which claimed that their medical marijuana sales were classified as medicine and therefore exempt from sales tax, the Board of Equalization ruled that Berkeley Patients Group’s sales of medical marijuana do not meet the definition of a sale of exempt medicine, and are therefore subject to tax.

The state Board of Equalization is contending that the Berkeley Patients Group, one of the oldest and largest medical cannabis dispensaries in California, owes $6 million in back taxes, Berkeleyside has learned.

Sorry, drug tsareviches, the scare won’t take, because you already used it in 1996. And with Prop 19, you won’t even have the power to go after all those federal felonies, like you have under Prop 215. The federal raids in California of legal dispensaries since 1996 are always coordinated with support of state, county, and local law enforcement, because there just aren’t enough G-men to police the nation’s most populous state. Prop 19 specifically forbids state, county, and local law enforcement from assisting in any operations to prosecute anyone for lawfully growing marijuana under Prop 19 or Prop 215:
